Patronal Attest abolished (vacation letter)
The new European tachograph regulation of February 4, 2014, will introduce a new "smart" tachograph at the beginning of 2017 that can be read remotely.
However, some articles of this new regulation will enter into force earlier. This means that the employer's certificate (declaration of activities) will no longer be mandatory as of March 2nd. In recent years, TLN (the Dutch Transport Authority) has successfully campaigned in Brussels to eliminate this significant administrative burden for companies. Article 34 of the new regulation states: "Member States may not require drivers to present documents proving their activities when they are away from the vehicle." This article of the regulation therefore abolishes the mandatory presence of the employer's certificate (declaration of activities). Drivers must, however, manually record in the digital tachograph what they have done during their absence from the vehicle (for example, if they have taken a holiday or performed other work).
